Academic promotion is granted under Article (7) of the Civil Service Law under the following conditions:
- Obtaining an academic degree higher than the qualification under which the employee was appointed
- The degree must be from an officially recognized institution
- The degree must be related to the nature of the employee's work
- Academic promotion is calculated regardless of the length of service
- The employee is re-appointed in the functional grade corresponding to the new qualification.
According to Article (8) of the Civil Service Law:
- Administrative Grievance: Submitting a written complaint to the direct supervisor or the higher authority.
- General Discipline Council: Recourse to it in case of non-response.
- Legal Codification Bureau: To object to decisions.
- Administrative Court / State Council: Judicial appeal against administrative decisions.
- The designated period for grievance is usually 30 days from the date the employee becomes aware of the decision.
Specified by Article (8) of the Law on Discipline of State and Public Sector Employees No. 14 of 1991:
- First: Attention Alert (Lafit Nadhar)
- Second: Warning (Inthar)
- Third: Salary deduction (1 to 10 days)
- Fourth: Salary deduction (11 to 30 days)
- Fifth: Delay of promotion for one year
- Sixth: Delay of promotion for two years
- Seventh: Demotion of grade
- Eighth: Dismissal from service.
- The employee has the right to change their guarantor in accordance with official administrative procedures.
- Approval of the concerned government entity is required.
- Guarantor change requests are submitted to the employee's department.
- It is permitted to change the guarantor due to their death, disability, or upon a justified request from the employee.
- The alternative guarantor must be a government employee or financially solvent.
Yes, in accordance with financial and administrative instructions:
- Contract service is counted for promotion and retirement if converted to permanent appointment.
- Wages are determined according to the unified salary scale issued by Cabinet decisions.
- The contractual employee is entitled to their salary only for the duration of the contract.
- They are not entitled to paid annual leave unless specified in the contract.
- The contract duration is counted as actual active service upon permanent confirmation.
Stipulated by Article (6) of the State Employees Discipline Law, including:
- Commitment to official working hours and no absence without excuse.
- Execution of supervisors' orders within the limits of the law.
- Preserving official work secrets.
- Not exploiting the position for personal interests.
- Decent treatment of visitors and colleagues.
- Refraining from commercial business that conflicts with the position.
- Safeguarding public funds and state property.
- In general, combining a government job and work in the private sector is prohibited.
- Exceptionally, this is allowed in specific cases with the approval of the competent authority.
- Faculty members are permitted to teach in private universities outside of official working hours and with the approval of the university presidency.
- The duration of service in the private sector is counted for retirement in certain cases under the Pension Law No. 27 of 2006.
- Allowance (Alawwah): A periodic increase in salary within the same functional grade (usually annual).
- Promotion (Tarqiyah): Moving to a higher functional grade based on efficiency and seniority.
- Elevation (Tarfee'): Moving to a higher rank or functional title (e.g., Director, Head of Department).
- Retirement (Taqaud): Terminating service and receiving a pension after reaching the retirement age (63 years) or completing service duration (30 years).
According to the Civil Service Law and Ministry of Higher Education instructions:
First - For General Employees:
- Regular Leave: 30 days per year.
- Sick Leave: With full salary for up to a year.
- Maternity Leave: 72 days with full salary.
- Hajj Leave: Once during the entire service.
- Study Leave: With or without salary depending on the case.
- Bereavement Leave: 3-7 days for the death of a relative.
Second - For Faculty Members:
- Enjoys semester-end and summer vacations.
- Scientific Research Leave: For travel and academic development.
- Sabbatical Leave: To complete scientific research and books.
According to the instructions of the Iraqi Ministry of Higher Education and Scientific Research:
- Assistant Lecturer: 16 hours per week.
- Lecturer: 14 hours per week.
- Assistant Professor: 12 hours per week.
- Professor: 10 hours per week.
- Supervision of postgraduate students is counted within the teaching load.
- A faculty member may be assigned additional hours for extra pay (contractual hours).
- Teaching outside the university requires official approval and is not calculated from the load.
According to Article 40 of the Iraqi Constitution of 2005:
The freedom of communications, including postal, telegraphic, telephone, and electronic correspondence, is guaranteed. It is prohibited to monitor or eavesdrop on such communications except for legal and security necessities.
The Law on the Right to Access Information No. 13 of 2016 regulates:
- Right of Access: The citizen has the right to access their personal information held by government entities.
- Limits of Disclosure: Personal data may not be disclosed without the consent of its owner.
- Exceptions: Disclosure is permitted only for security or judicial purposes.
- Responsible Authority: The Commission for the Right to Access Information.
The Iraqi Cybercrime Law No. 3 of 2011 is considered the most important in protecting student digital data:
- Article 3: Unauthorized access to electronic systems. Penalty: Imprisonment for a period not exceeding one year and/or a financial fine.
- Article 7: Seizing or leaking personal data. Penalty: Imprisonment for a period not exceeding three years.
- Article 8: Publishing personal information without consent. Penalty: Financial fine and imprisonment, depending on the extent of the damage.
- Article 9: Violation of the privacy of electronic communications. Penalty: Imprisonment and financial fine.
The Higher Education and Scientific Research Law No. 40 of 1988 and its Amendments obligates universities to:
- Maintain the confidentiality of students' academic records.
- Not disclose student grades except to the student personally or their guardians.
- Protect students' academic files from unauthorized access.
- Not share student data with external entities without permission.
The Ministry of Higher Education has issued administrative instructions specifying:
- University Number and ID: Highly confidential.
- Grades and Results: Confidential.
- Personal Information: Confidential.
- Health Records of Students: Highly confidential.
- Family and Guardian Data: Confidential.
- Personal Photos: Protected.
According to the guidelines, the University cannot do the following:
❌ Sell student/staff data to any commercial entity.
❌ Share student results on social media without their consent.
❌ Provide student/staff information to unauthorized persons.
❌ Use student photos for promotional purposes without their consent.
❌ Retain student data after their relationship with the university ends for unlawful purposes.
The Iraqi legal framework guarantees the following rights:
- Right to Access: The student/staff has the right to access all their data held by the university.
- Right to Rectification: The student/staff has the right to request correction of any incorrect information in their file.
- Right to Object: The student/staff has the right to object to the use of their data for non-educational purposes.
- Right to Complain through these channels: File a complaint to the Dean of the College -> Escalate to University Presidency -> Seek recourse from Ministry of Higher Education. For cybercrimes: National Information Security Agency.
